Criminal complaint filed against Dragan Brković: Suspected of causing €1.23 million in losses to Vektra Jakić’s creditors

A criminal complaint has been filed against Dragan Brković, Executive Director of Vektra Jakić LLC, based in Pljevlja, and the company itself, on suspicion that unlawful actions caused material damage to creditors amounting to €1,230,576.62.
Brković is suspected of having, between 2019 and 2021, knowingly made decisions to sell a number of industrial machines and vehicles owned by the company despite being aware that it had become insolvent. The assets sold included items pledged as collateral in favour of the Tax Administration to secure the collection of tax claims.
- Following the conclusion of sales contracts with several legal entities, assignment and set-off agreements were allegedly concluded, through which claims arising from the sales were transferred among related and other legal entities. The proceeds from the sales were subsequently paid into those companies’ accounts instead of the blocked accounts of Vektra Jakić LLC - the Police Directorate stated in a press release.
It is suspected that these actions partially enabled the evasion of tax obligations owed to the Tax Administration amounting to €236,185.64, while simultaneously preventing the enforced collection of other claims totalling €994,390.98.
- These claims were subject to account-blocking measures and included, among other things, claims held by the Municipality of Pljevlja and claims involved in enforcement proceedings - the police said.
Checks conducted with the Central Bank of Montenegro established that the company’s accounts were first blocked on 9 April 2015 and have remained continuously blocked since 1 June 2016. As of 3 December 2021, the company’s total recorded debt stood at €20,250,618.67, including, among other liabilities, taxes and social security contributions, concession fees, property taxes and outstanding employee wages.
- The police investigation in this case included checks into asset sales, agreements on the assignment of claims, money flows and the company’s prolonged account blockage. By analysing and cross-referencing the collected data, circumstances were identified indicating a suspicion that creditors had been prevented from recovering claims of substantial value, resulting in a criminal complaint being filed with the competent state prosecutor’s office - the Police Directorate concluded.
